This Refund Policy explains how DataConsultant reviews refunds, cancellations, credits, project fees, retainers, completed work, reserved resources, and third-party costs relating to its data consulting services.
1. Introduction and Scope
This Refund Policy explains how DataConsultant (“DataConsultant”, “we”, “our”, or “us”) handles refund, cancellation, service-credit, and payment-adjustment requests.
We provide professional data consulting and business-support services, including data analytics, business intelligence, data strategy, data engineering, data management, dashboards, reporting, artificial intelligence and machine learning support, data migration, integration, automation, database consulting, data-quality assessment, research, training, advisory services, technical support, dedicated professionals, and managed teams.
Because many services are customised, milestone-based, time-based, resource-dependent, or created specifically for an individual client, payments are not automatically refundable. Eligibility depends on the applicable agreement, project stage, work completed, resources reserved, and costs incurred.
Order of precedence: A signed contract, proposal, quotation, statement of work, purchase order, service order, data-processing agreement, or other written document may contain different refund or cancellation terms. Those specific terms will take precedence to the extent of any inconsistency, subject to applicable mandatory rights.
2. Purpose of This Policy
This policy explains:
- when a full or partial refund may be considered;

- how cancellations affect project, subscription, and retainer fees;

3. Scope and Application
This policy may apply to payments made through or under:

- proposals, quotations, and invoices;
- statements of work and service orders;
- subscription or retainer arrangements;
- project agreements and email confirmations;
- payment links, bank transfers, and approved online payment methods; or
- other written arrangements accepted by DataConsultant.
This policy applies to clients, prospective clients, authorised client representatives, website users who purchase services, and other parties responsible for payment. It does not automatically apply to payments made directly to independent third-party providers.
4. Key Definitions
Client
“Client” means the person, company, organisation, or authorised representative that purchases or receives services from DataConsultant.
Service Agreement
“Service Agreement” means any accepted proposal, quotation, statement of work, service order, invoice, purchase order, subscription agreement, retainer agreement, or other written arrangement describing the services and commercial terms.
Commencement of Work
“Commencement of Work” occurs when we begin discovery, consultations, research, planning, onboarding, resource allocation, technical setup, data review, development, modelling, testing, documentation, training preparation, or another activity connected with the engagement.
Third-Party Costs
“Third-Party Costs” include cloud fees, software licences, API charges, data-provider fees, hosting, specialist contractors, travel, payment-processing costs, and other approved external expenses.
5. General Refund Principles
Refund requests are reviewed individually and in good faith. We may consider:
- the applicable Service Agreement;
- whether work has started;
- completed work and work in progress;
- approved or substantially completed milestones;
- professional time already used;
- resources and team capacity reserved;
- third-party commitments and expenses;
- deliverables already supplied;
- client delays, changes, or dependencies;
- whether a reported issue can reasonably be corrected; and
- applicable legal requirements.
A change in a client’s budget, management, strategy, priorities, technology preference, or decision to use another supplier does not automatically create a right to a refund.
6. When a Refund May Be Available
Subject to the applicable Service Agreement, a full or partial refund may be considered where:
- a duplicate or excess payment was received;
- a cancellation was accepted before work began and before costs were incurred;
- DataConsultant confirms that it cannot provide a paid service;
- DataConsultant cancels without client breach and cannot provide a reasonable alternative;
- a material service issue attributable to us cannot reasonably be corrected;
- part of a prepaid service remains unperformed after an agreed termination;
- the parties agree in writing to a refund or credit; or
- a refund is required by applicable law.
Refund eligibility does not necessarily mean that the entire amount paid will be refunded.
7. Cancellation Before Work Begins
A full refund may be considered where a written cancellation request is received before work begins, no professional time has been used, no resources have been specifically reserved, and no non-recoverable third-party costs have been incurred.
Discovery, planning, onboarding, system access, staffing, research, consultations, and technical preparation may constitute work even where no final deliverable has yet been supplied.
Actual and non-recoverable banking, currency-conversion, or payment-processing charges may be deducted where permitted.
8. Cancellation After Work Has Begun
Where a client cancels after work begins, DataConsultant may retain or invoice amounts relating to:
- completed work and work in progress;
- consultations, meetings, and project management;
- approved or substantially completed milestones;
- technical setup, research, analysis, and documentation;
- reserved professional capacity;
- committed contractors or specialists;
- third-party costs and approved expenses; and
- other amounts due under the Service Agreement.
Any remaining unearned balance may be refunded or credited where appropriate.
9. Deposits, Advances, and Initial Payments
We may require a deposit, advance, mobilisation fee, or initial payment to reserve specialists, schedule capacity, begin discovery, prepare technical environments, engage approved resources, or purchase required services.
After work begins, an advance may be refundable only to the extent that it exceeds work performed, resources reserved, project preparation, approved expenses, third-party costs, and other valid amounts due.
A payment described as non-refundable will still be treated in accordance with any mandatory legal rights that apply.
10. Fixed-Fee, Milestone-Based, and Project Services
Fixed-fee services may include data audits, analytics projects, dashboards, data migrations, database optimisation, automation, artificial intelligence support, research, and consulting reports.
Fees allocated to completed or accepted stages are generally non-refundable. If a project is cancelled before completion, the amount payable may be calculated using completed milestones, the percentage of work completed, professional time used, work in progress, resources committed, and external costs incurred.
A milestone may be treated as accepted where the client approves it, authorises the next stage, uses or deploys the deliverable, or does not raise a specific material concern within an agreed review period.
11. Hourly Services, Retainers, and Recurring Services
Hourly and Time-Based Services
Fees for professional time already provided are generally non-refundable. Unused prepaid time may be refundable only where the applicable agreement permits it.
Retainers and Recurring Services
Unless the Service Agreement states otherwise, cancellation affects future billing after the applicable notice period. Fees for a billing period that has already started are generally non-refundable where work, availability, or capacity has been provided or reserved.
A prepaid long-term engagement may qualify for a proportionate refund for an uncommenced period after deducting supplied services, minimum commitments, reserved resources, third-party costs, and any disclosed discount adjustment.
12. Dedicated Professionals and Managed Teams
Fees for dedicated professionals or managed teams may cover recruitment, selection, onboarding, reserved availability, management oversight, reporting, team coordination, tool access, and operational support.
Fees for a period during which a professional or team was available as agreed are generally non-refundable, even where the client did not use all available capacity.
Notice periods, minimum terms, replacement procedures, and transition requirements should be governed by the applicable Service Agreement.
13. Training, Workshops, and Scheduled Sessions
Training, workshops, advisory calls, and scheduled consulting sessions may require advance booking. Unless different terms are stated:
- sessions may be rescheduled with reasonable advance notice, subject to availability;
- late cancellations may be non-refundable;
- failure to attend may be treated as a completed booking;
- preparation work may remain chargeable; and
- completed sessions are generally non-refundable.
If DataConsultant cancels and cannot offer a reasonable alternative, the fee for the cancelled session may be refunded or credited.
14. Client Data, Access, and Project Dependencies
Many services depend on the client providing accurate and timely datasets, system access, documentation, credentials, requirements, approvals, decisions, and feedback.
Refunds are generally not available for delays or additional costs caused by missing or inaccessible data, inaccurate information, corrupted datasets, delayed approvals, unavailable client personnel, restricted access, undisclosed legal restrictions, or failure to follow agreed procedures.
Client data will be handled according to the applicable Service Agreement, authorised client instructions, relevant confidentiality arrangements, and applicable legal obligations.
15. Changes in Scope
A refund is not normally available where the client changes the agreed scope after work has begun. Scope changes may include adding data sources, changing platforms, requesting new dashboards, revising business rules, replacing approved specifications, or expanding the number of systems, users, entities, or regions covered.
Changes may require a revised fee, schedule, or statement of work.
16. Data Quality, Analytics, and Artificial Intelligence Limitations
The quality of analytical, reporting, data-management, machine learning, and automated outputs may depend on the completeness, accuracy, consistency, relevance, and lawfulness of available data.
We do not promise perfect accuracy, uninterrupted services, error-free outputs, guaranteed predictions, complete security, or guaranteed commercial results.
A refund will not ordinarily be available solely because source data contains undisclosed errors, a forecast differs from an actual outcome, a model requires further validation, business conditions change, or a third-party platform changes its functionality.
Where a genuine material error attributable to DataConsultant is identified, we should be given a reasonable opportunity to investigate and correct it.
17. Third-Party Tools, Platforms, and Costs
We may use or recommend cloud platforms, databases, business-intelligence tools, data warehouses, APIs, software libraries, automation platforms, artificial intelligence tools, data providers, hosting services, and specialist providers.
Third-party costs are generally non-refundable once purchased, activated, consumed, committed, or made non-refundable by the provider.
Where an account or subscription is held directly by the client, refund requests must generally be made to that provider. We may reasonably assist, but we do not control or guarantee the third party’s decision or processing time.
18. Service Issues and Opportunity to Correct
A client who believes a service or deliverable materially fails to meet the agreed scope should contact us promptly and provide the project reference, the requirement believed not to have been met, supporting examples, and reasonable access required to investigate.
Where a concern is substantiated and attributable to DataConsultant, we may offer correction, re-performance, completion of missing work, replacement, revision, service credit, partial refund, or full refund for the affected component.
Where an issue can reasonably be corrected, we should ordinarily be given an opportunity to do so before a refund is considered.
19. Circumstances Generally Not Eligible for Refund
Subject to the applicable Service Agreement and applicable law, refunds are generally not available where:
- work has been completed and supplied as agreed;
- a milestone has been approved, deployed, published, or used;
- a consultation or training session has been completed;
- the client changes its strategy, budget, priorities, or supplier;
- required data, access, approvals, or feedback were not provided;
- the client changes the agreed scope;
- outputs are affected by inaccurate or incomplete client data;
- third-party services fail, change, or become unavailable;
- the client modifies a deliverable without authorisation;
- the service is used outside the agreed purpose;
- business results do not meet subjective expectations;
- fees relate to reserved capacity; or
- third-party costs have already been incurred.
20. Client Delay, Suspension, and Termination
A project may be paused where a client does not provide required information, data, access, approvals, feedback, cooperation, or payment. We may revise the schedule, reassign resources, suspend work, charge a disclosed restart fee, require a revised statement of work, or terminate the engagement where permitted.
We may also suspend or terminate services for overdue payment, material breach, unlawful instructions, system misuse, security concerns, abusive conduct, intellectual-property concerns, or repeated failure to cooperate.
Fees for completed work, work in progress, reserved resources, and third-party costs remain payable. If we terminate without client breach and cannot provide a reasonable alternative, we may refund the amount paid for the unperformed portion.
21. Duplicate, Failed, Pending, or Unauthorised Payments
Duplicate or Excess Payments
Where we confirm that the same invoice was paid more than once or that an excess amount was received, the excess may be refunded or applied as a credit.
Failed or Pending Payments
A payment shown as failed or pending may be automatically reversed by the relevant bank or payment provider. We cannot refund money that we have not received.
Unauthorised Payments
Suspected unauthorised transactions should be reported promptly to the relevant bank or payment provider and to support@dataconsultant.in. We may request reasonable information to verify and investigate the transaction.
22. Chargebacks and Payment Disputes
Clients are encouraged to contact us before initiating a chargeback so that we can investigate and address the issue.
A chargeback does not automatically cancel a Service Agreement or establish that a refund is due. We may provide relevant contracts, invoices, approvals, delivery records, work logs, and communications to a payment provider and may suspend services while a payment dispute is unresolved where permitted.
Nothing in this section prevents a client from raising a genuine dispute or exercising an available legal right.
23. How to Request a Refund or Cancellation

Please include:
- your full name and organisation;
- authorised contact details;
- invoice, proposal, project, or service reference;
- payment date, amount, method, and transaction reference;
- the service or milestone concerned;
- the reason for the request;
- the requested cancellation date, where relevant; and
- supporting documents or correspondence.
Security reminder: Do not send passwords, one-time passwords, full payment-card details, CVV codes, private encryption keys, or unnecessary confidential data.
24. Review, Calculation, and Processing
We may review the Service Agreement, payment records, work logs, communications, deliverables, milestone approvals, third-party invoices, client instructions, and other relevant information.
A partial refund may deduct completed work, professional time, work in progress, project management, reserved resources, third-party costs, non-cancellable commitments, taxes, payment charges, and other amounts validly due.
Approved refunds will normally be returned through the original payment method where reasonably possible. We aim to initiate an approved refund within 10 business days after approval and receipt of all necessary information. This is an administrative target and not a guarantee.
The time taken for funds to appear may depend on banks, payment gateways, card issuers, currency conversion, cross-border payment systems, verification requirements, and other circumstances outside our direct control.
25. Service Credits, Deliverables, Intellectual Property, and Client Data
Where both parties agree, an otherwise refundable amount may be issued as a service credit. Unless otherwise agreed, a credit is non-transferable, cannot be resold or exchanged for cash, and may be subject to a disclosed expiry period.
Cancellation or refund does not automatically transfer ownership of source code, models, methods, templates, working files, drafts, tools, documentation, or other intellectual property. Ownership and licence rights are governed by the applicable Service Agreement.
Cancellation does not automatically end confidentiality, data-protection, security, intellectual-property, or record-retention obligations. Client data will continue to be handled according to the applicable agreement, authorised instructions, relevant legal obligations, and legitimate retention requirements.
26. International Clients and Cross-Border Payments
DataConsultant may provide services internationally. Refund processing may be affected by different banking systems, currency conversion, tax requirements, payment-provider restrictions, verification checks, local mandatory rights, and cross-border transfer delays.
We are not responsible for exchange-rate differences or charges independently imposed by a client’s bank or payment provider.
Clients should seek independent legal, tax, financial, or professional advice where guidance is required about rights or obligations in a particular country.
27. Website Use, Contracts, and Other Policies
Browsing the DataConsultant website or submitting a general enquiry does not normally involve a refundable payment. Where the website permits paid bookings, subscriptions, deposits, or service purchases, this policy applies together with the terms shown during the purchase process.
Website descriptions do not replace the specific scope, fees, assumptions, dependencies, exclusions, acceptance criteria, confidentiality obligations, data-processing terms, intellectual-property provisions, payment terms, liability provisions, or security responsibilities in a Service Agreement.

We may update this policy periodically to reflect changes in our services, payment methods, business operations, contracts, technology, third-party platforms, or legal requirements.
